Terms and Conditions


Registered users are requested to comply with these basic terms and conditions when posting information about their products, tools or services (hereafter called “products”) on the Water Europe Marketplace (hereafter called “Marketplace”).

Product eligibility

The product must be directly related to one of the three pillars of the Circular Economy (CE), namely Water, Energy or Materials/Nutrients or indirectly related as a product that supports the CE (e.g. a software product). Applicants may be requested to provide evidence for this relation.

Additionally, products must be "Market Ready", indicating they are at the TRL9 stage, having undergone comprehensive development. They have been applied under market conditions, demonstrating their readiness for broader deployment. This category also includes products that, despite being fully operational and prepared for deployment, might not have attained the same level of market readiness as others due to factors such as pending regulatory approvals, funding limitations, or strategic timing decisions.

Ownership and responsibility

The user uploading information to the Marketplace, or the organisation/company they represent ("the owner"), must own the product and ensure the published information remains current and accurate. The product factsheet will be accessible on the Marketplace for one year, during which the owner is responsible for updating any relevant information.

Issuing Calls for Solutions

Registered users have the opportunity to issue calls for solutions addressing challenges within the circular economy. These calls, once approved, will become publicly visible, allowing the community and stakeholders to offer responses and engage in collaborative problem-solving. Water Europe reserves the discretionary authority to reject any call that does not align with its standards or objectives. To ensure content remains relevant and current, calls that are not renewed will be automatically removed from the platform after three months, ensuring the platform remains dynamic and up-to-date with current challenges and solutions.

Liability and offending material

The uploaded information is the exclusive legal responsibility of the individual or organisation/company that uploads it. Water Europe disclaims any responsibility for errors or omissions, as well as for the outcomes derived from utilizing the uploaded information, which is provided "as is" without any warranty by Water Europe regarding its completeness, accuracy, timeliness, or the results obtained from its use. The uploaded information must not contain any offensive material or material that violates the law. The administrator of the Marketplace reserves the right to remove any information from the Marketplace that fails to comply with the terms and conditions.

Additionally, by uploading and publishing information about their product on the Marketplace, product owners agree not to imply or suggest in any manner that Water Europe supports or endorses their product. Water Europe does not endorse any product or service advertised on its Marketplace. Product owners acknowledge that Water Europe bears no responsibility for any claims, warranties, or representations made by them. Furthermore, they agree to indemnify and hold Water Europe harmless against any damages, losses, and expenses resulting from any claims, actions, or demands made by third parties in connection \ to the use or purchase of the product.

All content featured in or made accessible through the Marketplace, including text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, belongs to Water Europe or its content providers and is safeguarded by Belgian and European copyright laws. The compilation of all content available through any Marketplace service is the exclusive property of Water Europe, and protected by Belgian and European copyright laws.

Furthermore, graphics, logos, page headers, button icons, scripts, and service names featured in or provided through the Water Europe Marketplace are not to be utilized in association with any product or service in a way that could cause confusion among customers, or in any manner that disparages or discredits Water Europe or the Marketplace and its members. Trademarks not owned by Water Europe that appear in any Marketplace service belong to their respective owners, who may or may not have an affiliation with, connection to, or sponsorship from Water Europe.

Use of uploaded information

The uploaded information will be made available for public use and the owner grants others the right to use their information without having to obtain additional permissions or licenses.

Change of terms and conditions

Water Europe reserves the right to modify to the Marketplace site, policies, service terms, and these conditions of use at any time. Should any of these conditions be deemed invalid, void, or for any reason unenforceable, that condition shall be considered severable and will not impact the validity and enforceability of the remaining conditions. Product owners are responsible for periodically reviewing these terms and conditions of use. Continued use of the site and services of the Marketplace following any modifications to the terms and conditions of use will be regarded as acceptance of those modifications.

Acceptance

By uploading a product, the product owner agrees to accept all the terms and conditions of the Marketplace and acknowledges that Water Europe is relying upon the user's stated acceptance of these terms and conditions.

Disputes

Any dispute or claim arising from or related to your use of any Marketplace services will be resolved in the courts of Brussels, Belgium, and you agree to exclusive jurisdiction and venue in these courts.
